2025-038 An Ordinance Of The Township Of Lakewood, County Of Ocean, State Of New Jersey, Accepting Dedication Of 19,715.79 SQ. FT. Right-Of-Way Easement Of Franklin Boulevard
WHEREAS, Erwin & Ruth Zafir are the owners of Block 500, Lots 21 and 41.01 in the Township of Lakewood; and

WHEREAS, this property consists of 3.26+/- acres of land with frontage on Bellevue Avenue; and

WHEREAS, previously the property also contained frontage on Franklin Blvd, but by way of a vacation of a portion of Franklin Boulevard, 19,715.79 sq. ft. was returned to the lot, effectively eliminating any frontage on Franklin Boulevard; and

WHEREAS, Erwin & Ruth Zafir has agreed to a rededication of this portion of the paper street of Franklin Boulevard and as particularly described on the attached Metes & Bounds description annexed hereto; and

WHEREAS, the Township of Lakewood is desirous of accepting this Rededication of this portion of the Zafir’s property, to be rededicated and constitute a portion of Franklin Boulevard, and the Township hereby accepts this dedication of the right of way as described on the attached Metes & Bounds description:

NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Township of Lakewood, County of Ocean, State of New Jersey accepts the portion of land identified on the attached Metes & Bounds description. and it is hereby enacted and ordained by the authority of same as follows:

SECTION 1. The Township of Lakewood hereby accepts the portions of land identifying Franklin Boulevard Right of Way, and as more specifically described in the attached Metes & Bounds description referenced above.
SECTION 2. The Township Clerk shall within sixty (60) days after such ordinance becomes effective file a certified copy of the ordinance accepting the dedication of the street with the office of the County Clerk in a special book set aside for dedications and vacations, pursuant to N.J.S.A. 40:67-21.

SECTION 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency.

SECTION 4. If any section, subsection, paragraph, sentence or any part of this ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance not directly involved in the controversy in which such judgment shall have been rendered.


SECTION 5. This Ordinance shall take effect upon final passage and publication in accordance with law.
